1. Purpose
These terms of use ("Terms") set out how you may access and use the Portfoler platform, published by the company identified in the legal notice. By creating an account or using the service, you confirm that you have read and accepted these Terms and the privacy policy. If you do not accept them, you must not use the platform.
2. Definitions
"Publisher" means the company operating Portfoler, identified in the legal notice. "Platform" means the Portfoler website and its services. "User" means any person who creates an account or browses the platform. "Content" means the information published by the User (profile, CV, portfolio, posts, comments, recommendations, messages, services, offers, company page).
3. User account
Registration is limited to people aged 16 or over (or the age of digital consent applicable in their country) and requires a valid email address. You agree to provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for any activity carried out from your account; any unauthorized use must be reported to us without delay.
4. Use of the service
You agree to use the platform lawfully and fairly. In particular, the following are prohibited: publishing unlawful, hateful, defamatory or misleading content or content that infringes the rights of others; impersonation; sending unsolicited messages; automated collection (scraping) of other users' data; and any attempt to circumvent the security measures of the service. Personal data of other users that you can access may only be used for the purposes intended by the platform.
5. Published content
You remain the owner of the content you publish and warrant that you hold the necessary rights, including to the photos and documents you upload. You grant the Publisher a non-exclusive, royalty-free, worldwide licence, for the duration of publication, to host, reproduce and display this content solely in order to provide the service. Information you make public can be viewed by any visitor and indexed by search engines; you can restrict its visibility at any time.
6. Reporting and moderation
Any user can report content they consider unlawful or contrary to these Terms, using the platform's reporting tools or the contact form. Reports are reviewed diligently and objectively. The Publisher may remove content, restrict its visibility or suspend an account; the person concerned is then informed of the decision and the reasons for it, and may challenge it by writing to us. For users located in the European Union, these rules apply in accordance with the EU Digital Services Act (DSA).
7. Intellectual property
The platform, its brand, logo, design, texts, illustrations and CV templates are protected by intellectual property law. The illustrations and visuals on the site are generated by artificial intelligence. Any unauthorized reproduction or use is prohibited.
8. Personal data
Your personal data is processed in accordance with our privacy policy, in compliance with Moroccan Law No. 09-08, the European Union General Data Protection Regulation (GDPR) and applicable US privacy laws. You can at any time deactivate your public profile, export your data or request the deletion of your account.
9. Information security
The security of your data is a priority. Communications with the platform are encrypted (HTTPS), your passwords are stored in hashed form and access to your information is strictly controlled and logged. You remain in control of your profile's visibility at all times. Portfoler does not sell your data and uses no advertising tracking. In the event of a data breach likely to pose a risk to your rights, we notify the competent authorities and, where applicable, the people concerned within the time limits set by law.
10. Cookies
Portfoler only uses cookies that are strictly necessary for the service to work: authentication cookies (keeping you signed in) and security cookies (CSRF protection). Your display preferences (language, light or dark theme) are stored locally in your browser. No advertising cookies or third-party trackers are used; should non-essential cookies ever be introduced, they would only be set with your prior consent. You can configure your browser to block cookies, but some features — such as signing in — may then stop working.
11. Liability
The Publisher strives to ensure the accuracy of information and the availability of the service, without guaranteeing that it will be free from errors or interruptions. It is not responsible for content published by users or for relationships (recruitment, services, sales) formed between users through the platform. Nothing in these Terms limits the rights granted to you by the mandatory consumer protection provisions of your country or state of residence.
12. Service availability
The service is provided "as is". We may change, suspend or discontinue all or part of the platform for maintenance or improvement, and will endeavour to inform you in advance where possible.
13. Termination
You can delete your account at any time from your settings; your data is then permanently erased within 30 days, subject to legal retention obligations. The Publisher may suspend or close an account in the event of a serious or repeated breach of these Terms, after informing the user, except in an emergency or where required by law.
14. Applicable law
These Terms are governed by Moroccan law. Failing an amicable settlement, any dispute falls within the jurisdiction of the courts of Rabat. If you are a consumer residing in the European Union or the United States, you retain the benefit of the mandatory protective provisions of the law of your country or state of residence.
15. Changes to the terms
We may amend these Terms to reflect legal changes or changes to the service. Any substantial change will be notified to you (by email or on the platform) at least 30 days before it takes effect; continued use of the service constitutes acceptance. If you do not accept the new terms, you can delete your account.
